Budapest court requests EP to lift immunity of ‘primary defendant in antifa case’
In a statement, the court said that it had suspended its proceedings against the woman, referred to by her initials S.I., adding that she had won a mandate to sit in the new European Parliament on the list of the Italian Green and Left Alliance. The court also added that the defendant had been released from house arrest.
The court noted that MEPs could not be taken into custody or subjected to any court procedures in EU member states. They added that MEP’s were already entitled to immunity court procedures in EU member states. They added that MEP’s were already entitled to immunity “from the time their election to the EP is officially announced” and they “start their journey to the opening session of the new EP”.
It said that a person with an immunity cannot be questioned as a suspect or taken into custody before their immunity is removed.
S.I. was persecuted for complicity on charges of assaulting people in Budapest.
